The trial of Senior Advocate of Nigeria, Dele Belgore SAN and former minister of National Planning, Prof Abubakar Suleiman which was scheduled to begin today has been further adjourned due to the unavailability of the prosecution’s witness.
Mr. N.M. Anana, the prosecuting counsel informed the court that the lead prosecutor in the charge was experiencing some challenges getting to court. He further stated that the witness who was to testify at today’s proceedings is also yet to arrive from Ekiti State. He applied for a stand down of the charge.
Opposing the application for a stand down, Mr. Sofunde SAN, who led the legal team for Mr. Belgore SAN, stated that he preferred that the charge be adjourned, as there is no certainty as to when the witness would arrive seeing that he is coming from Ekiti. Mr. Ayanlaja SAN who led the defence team for Prof Suleiman also agreed that it was preferable to adjourn the charge, as it was clear that the prosecution was not ready to proceed with trial.
The court held that it was appropriate to adjourn the charge, as the court could not work with uncertainties and the prosecutor could not say precisely when the witness would arrive. He charged the prosecution to show more seriousness with the charge stating that logistics demand that a witness coming from out of state to testify would have arrived the day before as well as the prosecution preparing other witnesses who are within the state to testify.
The charge has been adjourned to the 13th and 14th of March 2017 for trial.
